In force as of [DATE].
Article 1 — Purpose and scope
These Terms govern sales of carbon-fibre frames and framesets and accessories (the “Products”) concluded on drakkarbikes.com between [COMPANY_NAME] (the “Seller”) and any consumer buyer (the “Customer”). Placing an order implies unconditional acceptance of these Terms.
Article 2 — Made-to-order products
The Customer is expressly informed that the Products are made to order and, where a colour, finish or logo is chosen, personalised to their specifications. No permanent stock is held: each frame is produced and painted after the order is validated.
Article 3 — Prices
Prices are shown in euros (€), all taxes included, with applicable VAT. The Seller acts as importer: unless otherwise stated at the time of order, no additional customs duties or import taxes are payable by the Customer within the European Union. Personalisation options (premium finish, extra colours, logo) are charged as a supplement shown before checkout. The Seller may change prices at any time; the price applicable is the one in force on the day of the order.
Article 4 — Order
The sale is concluded once the order is validated and paid in full by the Customer, confirmed by a summary email. The Seller may refuse or cancel any order in the event of a payment dispute, an abnormal order or a supply shortage, with no compensation other than a refund of sums paid.
Article 5 — Personalisation (proof approval)
For personalised Products (paint, logo), a proof describing the colours (Pantone/RAL references) and logo placement is submitted to the Customer for approval before production starts. Production only begins after the Customer’s written approval of the proof. The Customer warrants that they hold the rights to any artwork/logo they supply.
Article 6 — Payment
Payment is made at the time of order, by the means offered on the site. Payment data is processed by secure providers; the Seller has no access to card numbers. The Product is manufactured after payment is received.
Article 7 — Manufacturing and delivery times
Given made-to-order production and painting, the indicative lead time is 8 to 10 weeks from approval of the proof (or from the order if no proof is required), transport included. This time is stated before the order in accordance with EU consumer information rules. In the event of significant, unjustified delay, the Customer may, after a formal notice that remains without effect within a reasonable time, terminate the sale and be refunded. Delivery is made to the address given by the Customer. Risk passes to the Customer on handover of the Product.
Article 8 — Right of withdrawal
8.1 — Personalised products (exclusion). In accordance with Article 16(c) of Directive 2011/83/EU (and its national implementations), the right of withdrawal does not apply to the supply of goods made to the Customer’s specifications or clearly personalised (choice of colour, finish, logo). By validating a personalised order, the Customer acknowledges waiving their right of withdrawal.
8.2 — Non-personalised products. For a Product delivered in a standard finish with no personalisation, the Customer has 14 days from receipt to exercise their right of withdrawal, without reason, using the model form below or any unambiguous statement sent to [EMAIL]. Products must be returned as new, unbuilt and unused, in their original packaging; return costs are borne by the Customer. The refund is made within 14 days of recovering the Product or proof of its return shipment.
Model withdrawal form. To [COMPANY_NAME], [REGISTERED_ADDRESS], [EMAIL]: I hereby give notice of withdrawal from the contract for order no. … placed on … — Name, address, date, signature.
Article 9 — Legal guarantees
The Seller is liable for lack of conformity under Directive (EU) 2019/771 (legal guarantee of conformity, minimum 2 years from delivery) and for hidden defects under applicable law. The Customer may choose between repair or replacement, subject to legal conditions. These guarantees apply regardless of any commercial warranty. Frames also carry a 2-year manufacturer warranty (ISO 4210 standard). Excluded are damage from abnormal use, impact/crash, incorrect assembly, overload or normal wear.
Article 10 — Retention of title
Products remain the Seller’s property until the price is paid in full.
Article 11 — Liability
The Seller cannot be held liable for non-performance due to force majeure. Stated specifications and weights are indicative within manufacturer tolerances. A carbon frame must be assembled by a competent person, at the recommended torque values.
Article 12 — Personal data
Data processing is described in the [Privacy Policy].
Article 13 — Mediation and disputes
The Customer may use free consumer mediation: [MEDIATOR_NAME] — [MEDIATOR_URL]. The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr. Failing an amicable settlement, disputes fall under the competent French courts; French law applies, without prejudice to the mandatory consumer-protection rules of the Customer’s country of residence.
